Terms of Service

The service

Sartoria provides software for builders to present finish options to their clients, track selections against allowances, and produce selection documents and records. We provide the tools; the selections, prices, allowances, and content a builder enters are the builder’s own.

Your account

• ·You are responsible for the accuracy of the information you enter, including client information, prices, and allowances.
• ·You are responsible for keeping your login credentials and client links confidential and for activity under your account.
• ·You must have the right to use any information you add about your clients and to load the product options and images you upload.

Acceptable use

You agree not to misuse the service. In particular, you will not:

• ·Use it for any unlawful purpose or to store unlawful content.
• ·Attempt to breach its security, disrupt it, or access data that is not yours.
• ·Resell or provide access to it in a way not permitted by your plan.

Fees and billing

Paid plans are billed in advance on a monthly or annual basis, as selected. Plans are month-to-month unless an annual term is chosen; you may cancel at any time and will retain access through the end of your paid period. Fees are non-refundable except where required by law. We will give reasonable notice before changing subscription pricing.

Your data and selection records

As between you and Sartoria, you own the project and selection data you create, and you can export it at any time. You grant us the limited rights needed to host and operate the service for you. The selection documents and records the product generates are tools to help you run your process — Sartoria is not a party to any agreement between you and your client, and nothing in the product constitutes legal advice. You are responsible for how you use these records with your clients, including whether and how they form part of a contract.

Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that it will produce any particular business outcome, such as preventing disputes or overages.

Limitation of liability

To the fullest extent permitted by law, Sartoria will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, or data. Our total liability arising out of or relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Sartoria harmless from claims arising out of your content, your use of the service, or your dealings with your clients, to the extent permitted by law.

Term and termination

You may stop using the service and cancel at any time. We may suspend or terminate access for a material breach of these terms or where required to protect the service or comply with law. On termination, you may export your data for a reasonable period before it is deleted.

Changes

We may update these terms as the service evolves. When we make material changes, we will update the date above and, where appropriate, notify account holders. Continued use after an update means you accept the revised terms.

Governing law

These terms are governed by the laws of the United States and the state in which Sartoria is established, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located there.
